Terms of Service

Mindus Forge (hereinafter "the Platform") is a SaaS code generation solution powered by artificial intelligence, published by Mindus SAS, a company registered with the Paris Trade and Companies Register under number 912 345 678. These terms govern access to and use of the Platform, its APIs, web interfaces, and associated tools. By using Mindus Forge, you acknowledge that you have read and agree to be bound by all of the following clauses.
1. Definitions
User: any natural or legal person accessing the Platform, whether through a free or paid account.
Generated Code: any file, fragment, script, configuration, or documentation produced by the Mindus Forge AI at the User's request.
Repository: source code storage space (GitHub, GitLab, etc.) that the User chooses to connect to the Platform.
Resilience: functionality that allows operations to continue in offline mode with subsequent synchronization.
2. Acceptance of Terms
Using Mindus Forge implies full and complete acceptance of these Terms of Service. If you use the Platform on behalf of a legal entity, you represent that you have the authority to bind that entity. Mindus SAS reserves the right to modify these terms at any time; Users will be notified via the Platform or by email. The applicable version is the one in effect at the time of use.
3. Account Creation and Security
Access to the Platform requires registration via GitHub OAuth or email. The User is responsible for maintaining the confidentiality of their credentials. Any activity occurring from their account is deemed to be their own. In the event of loss, unauthorized use, or security breach, the User must immediately contact support@mindusforge.dev. Mindus SAS cannot be held liable for damages resulting from identity theft.
4. Subscriptions, Billing, and Pricing
Mindus Forge offers free plans (limited in generation volume) and paid plans (monthly or annual). Prices are shown on the /pricing page, in euros excluding taxes. Payment is due in advance, by credit card or wire transfer. In the event of payment failure, access may be suspended. The User may cancel at any time from their account; cancellation takes effect at the end of the current period. No partial refunds are granted for early cancellation, except as required by mandatory law.
4.1 Scale and Enterprise Plans
Scale and Enterprise plans allow the use of a personal Gemini API key. The User is solely responsible for the use of this key and compliance with Google's terms. Mindus SAS does not have access to the key in clear text after configuration. Enterprise plan billing is established by quote and is subject to a separate contract.
5. Platform Access and Resilience
Mindus Forge is accessible 24/7, subject to maintenance operations. The resilience feature allows the User to continue generating code even when disconnected: data is stored locally (secure cache) and automatically synchronized when back online. Mindus SAS implements encrypted backups but cannot guarantee complete absence of loss in the event of extreme hardware failure. The User is encouraged to keep copies of their work via Git.
6. AI Usage – Code Generation
The Platform uses artificial intelligence models (including Google's Gemini) to produce code based on the User's instructions. The User acknowledges that generated code may contain errors, inconsistencies, or vulnerabilities. It is their responsibility to verify, test, and validate any code before deploying it to production. Mindus SAS shall not be held liable for direct or indirect damages resulting from the use of generated code.
6.1 Analysis of Existing Repositories
When the User authorizes Mindus Forge to analyze a repository (GitHub, GitLab, etc.), the Platform reads files to understand the architecture, conventions, and dependencies. This data is used solely to improve the relevance of generated code and is not reused for other purposes. The User warrants that they have the necessary rights to authorize this analysis.
6.2 /forge/ Subfolders
By default, Mindus Forge generates code in a /forge/ or /forge-[feature]/ subfolder at the root of the repository or workspace. This convention prevents accidental overwriting of existing code. The User may modify this behavior via advanced settings, at their own risk.
7. Intellectual Property
7.1 Generated Code: Mindus SAS assigns to the User all proprietary rights to the generated code, except for generic code snippets or reusable templates (MIT license included in the Platform). The User is free to use this code as they wish.
7.2 Platform and AI: The software, algorithms, models, interfaces, and trademarks of Mindus Forge remain the exclusive property of Mindus SAS. These terms do not imply any transfer of rights to these elements.
8. Personal Data and Privacy
The processing of personal data is governed by our Privacy Policy, accessible on the site. In accordance with GDPR, the User has the right to access, rectify, and delete their data. Code data (repositories, files) is not considered personal data, but is treated with the same rigor: encryption in transit, restricted access, no use for model training without prior anonymization.
9. User Obligations and Conduct
The User agrees not to use Mindus Forge to:
- Generate malicious, illegal, or offensive code;
- Attempt to bypass technical limits, conduct brute force attacks, or reverse engineer the models;
- Infringe upon the intellectual property rights of third parties;
- Host or share code containing sensitive information (passwords, private keys) without precautions;
- Use the Platform for development activities related to weapons, mass surveillance, or human rights violations.
Any violation may result in immediate suspension of the account without notice or refund.
10. Warranties and Liability
Mindus Forge is provided "as is," without express or implied warranty of fitness for a particular purpose. We strive to maintain a quality service but do not guarantee the complete absence of errors, interruptions, or bugs. To the extent permitted by law, Mindus SAS's liability is limited to the amount paid by the User in the twelve months preceding the incident.
10.1 Critical Generations
The User acknowledges that generated code may serve as a basis for critical applications (healthcare, finance, infrastructure). It is their responsibility to implement all necessary tests. Mindus SAS cannot be held liable for malfunctions, data loss, business interruption, or commercial damages.
11. Force Majeure
Mindus SAS shall not be liable for any failure or delay in performance due to a force majeure event as defined by French case law (unpredictable, unavoidable, and external event).
12. Term and Termination
These terms are effective for an indefinite period from the User's acceptance. The User may terminate their account at any time from the interface. Mindus SAS may terminate a User's account in the event of a material breach after unsuccessful notice. Termination results in the deletion of the User's data within 30 days, except as required by law.
13. Support and Assistance
Support is provided by email at support@mindusforge.dev, with response times varying by plan (48h for free accounts, 12h for paid accounts, priority for Enterprise). A help center and documentation are available online.
14. Miscellaneous Provisions
Language: These Terms are written in English. In case of translation, the English version shall prevail.
Partial Invalidity: If any clause is held invalid, the remaining clauses remain fully enforceable.
No Waiver: Mindus SAS's failure to enforce a breach does not constitute a waiver of its right to enforce it later.
15. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, the courts of Paris shall have jurisdiction, unless otherwise required by mandatory law. For any dispute with a professional, this jurisdiction clause is fully applicable.
